Terms of sale
1. GENERAL
1.1 The online store (hereinafter referred to as "Online Shop") belongs to Magnetic Baltic OÜ (registration code 16633635) located at Noorkuu 6-12, Tallinn, 13516 Harjumaakond, Estonia.
1.2. These Terms and Conditions of Use regulate the legal relationship arising between Magnetic Baltic OÜ (Seller) and the person who has made the purchase (Buyer) when buying and selling at the online store.
1.3. In addition to these terms and conditions, the legal relationship arising in connection with the distribution of goods through the online store shall be governed by the laws of the Republic of Estonia.
1.4. The seller can change the terms and conditions of use of the online store and the prices of goods and services. The changes will be notified in the environment of the online store. The terms and prices valid at the time of the transaction shall apply to the transaction.
1.5. The range of goods, prices and discounts may differ from the selection of goods, prices and discounts in retail stores of the Seller.
2. PRICE
2.1. The information regarding the goods will be provided in the online store immediately together with the goods and will include the VAT of 20% valid in the Republic of Estonia.
2.2. The prices of the goods are listed in the online store next to the goods. The price includes a delivery fee, unless otherwise specified when paying for the goods. The fee for the delivery of goods depends on the location of the Buyer and the method of delivery. The cost of delivery is displayed to the Buyer when placing an order.
2.3 The online store has the right to refuse the transaction of sale and to demand the return of goods from the Buyer if the price of goods in the online store is indicated significantly below the market price of the goods due to an error.
3. ORDERING
3.1. To order an item you have to add the desired items to the shopping cart. To place the order, you must fill in the required fields of data and choose the appropriate method of delivery of the goods.
3.2 It is possible to change the goods and their quantity in the cart, as well as to remove goods from the cart until the goods are paid for.
3.3 When ordering, the final price is displayed on the screen, which can be paid with a bank link or other payment solution.
3.4 The contract enters into force from the moment the amount payable to the current account of the online store.
3.5 The Seller sends a notice of order confirmation to the Buyer's email address. If the letter is not found in the mailbox, check whether it accidentally got into the spam folder.
3.6 The Seller has the right to withdraw from the contract if the ordered goods cannot be delivered due to the end of the product or for any other reason. The Seller will inform the Buyer about this as soon as possible and will return all received payments for the ordered goods (including delivery costs) without delay, but no later than within 14 days from the moment of sending the notice.
4. PAYMENT
4.1 The Buyer shall make a 100% prepayment for purchases made in the online store.
4.2 Orders can be paid via Estonian bank links or based on an invoice.
4.3. Payments are mediated by Maksekeskus AS. Payment is made outside the Webshop in a secure environment - when paying with a bank link, in the secure environment of the respective bank, and in the secure environment of Maksekeskus AS when paying with a credit card. The seller does not have access to the customer's bank and credit card data. The contract enters into force from the receipt of the amount to be paid to the current account of the Online Store. The owner of the online store is the responsible processor of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.
4.4. Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele.
4.5. Visa/Mastercard card payments
4.6. Finnish bank links: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästopankki, Pohjola, POP Pankki, S-Pankki, Säästopankki
4.7. Latvian bank payments: Swedbank, SEB, Citadele, Citadele and Luminor
4.8. Lithuanian bank payments: Swedbank, SEB, Citadele, Šiauliu and Luminor
4.9. If the ordered goods cannot be delivered due to the end of the goods or for some other reason, the buyer will be informed of this as soon as possible and the money paid (including the costs of delivering the goods) will be returned without delay, but no later than within 14 days of sending the notice.
5. DELIVERY
5.1. Goods are sent to the following countries: Estonia, Latvia, Lithuania, Finland.
5.2. The products are delivered according to the way chosen by the Buyer in the Online Store - OMNIVA, ITELLA.
5.3. The shipping costs of the goods are borne by the Buyer, and the corresponding price information is displayed next to the shipping method.
5.4. The seller ships orders on all working days, but no later than within five working days after order confirmation. In exceptional cases, you have the right to deliver the goods within 45 calendar days. The latter includes special orders.
6. RIGHT OF WITHDRAWAL, RETURN AND EXCHANGE OF PRODUCTS
6.1 The buyer has the right to withdraw from the transaction within 14 calendar days by sending the seller a written withdrawal from the purchase of goods, which contains the following information
- First and last name
- Contact phone number
- Email address
- Address
- Bank account details
- Date of order
- Item receiving date
- Name of item to be returned
- Product serial number
- Invoice number for the product
- Reason for return
6.2 The Buyer shall send the withdrawal notice to magneticbaltic@gmail.com or to Väike-Põllu 7, Sindi linn, Pärnumaa, 86705, Estonia, not later than 14 calendar days after receiving the goods. The Seller shall confirm the receipt of the application for withdrawal with the notice sent to the Buyer.
6.3 The returned product shall include all the documentation about the purchase. Labels affixed to the goods and items installed to preserve the condition of the goods
6.4 To exercise the 14-day right of return, the ordered goods must not be used in any way other than to test the nature, characteristics and functioning of the goods in the same way as permitted for trying out goods in a physical store. If the goods have been used for purposes other than those necessary to test the nature, characteristics and functioning of the goods, or if they show signs of use or wear and tear, Seller is entitled to reduce the amount to be returned in accordance with the reduction. in the value of the goods or to refuse to refund the value of the goods.
6.7 The Buyer is obliged to return the goods subject to return within 14 calendar days from the date of application for withdrawal from the purchase of goods.
6.8 Until the returned goods are accepted, the Seller is not responsible for the goods. The return and/or exchange of goods is free of charge, except for the transportation costs of return, which shall be borne by the Buyer. If the Buyer receives low-quality goods, the costs of return shall be borne by the Seller.
6.9 Upon receipt of the returned goods, the Seller shall immediately, but no later than 14 days after receipt of the rejection, return to the Buyer all fees received from the Buyer based on the contract, including transportation costs. If the Buyer has explicitly chosen a method of delivery other than the cheapest usual method of delivery offered by the online store, the Seller is not obliged to return to the Buyer the cost more than the cost associated with the usual method of delivery.
6.10. The Seller reserves the right to postpone the refund until the goods that are the subject of the contract are returned.
6.11. The Seller has the right to refuse the sale transaction and demand a refund from the Buyer if the price of goods in the online store is indicated significantly lower than the market price of the goods due to an error.
7. RIGHT TO COMPLAIN
7.1 The Seller shall be liable for non-compliance of the goods sold to the Buyer with the terms and conditions of the contract or for the defect that already existed at the time of handing over the item and that manifested itself within two years from the date of handing over the goods to the Buyer. The Buyer, within the first six months of handing over the item to the Buyer, assumes that the defect already existed at the time of handing over the item. It is Seller's responsibility to refute the relevant assumption. The Seller is not liable for defects that occur after the goods have been handed over to the Buyer.
7.2 In case the Buyer finds any discrepancy or defects in the products, the Buyer shall immediately, but no later than within 14 days after becoming aware of the discrepancy, notify the Seller thereof by sending the relevant information to magneticbaltic@gmail.com or in writing to the address: Väike-Põllu 7, Sindi linn, Pärnumaa, 86705, Estonia.
7.3 In case of non-compliance or defects of the goods, the Buyer shall have the right to demand replacement of the goods with the goods that meet the requirements and have no defects or return the goods at the expense of the Seller.
7.4 In case of returning the goods that do not meet the requirements, the Buyer shall be refunded the amount paid for the goods together with the cost of delivery to the bank account specified by the Buyer, no later than within 14 days. The Seller shall have the right to postpone the refund of the amounts paid until the Buyer returns the goods in his hands.
7.5 In case of any disagreement between the Buyer and the Seller regarding defects of goods, the Buyer may file a complaint with the Seller, stating its name and contact details, date of complaint, defect of goods and its own recommended solution in the complaint submitted in writing or in a format which can be reproduced in writing. The Seller shall respond to the Buyer's complaint in writing or in a form that can be reproduced in writing within 14 calendar days. If the Buyer has any claims against the online store, they shall be sent to the e-mail address magneticbaltic@gmail.com.
7.6 If the Buyer and the Seller fail to reach an agreement regarding the dispute, the Buyer shall have the right to apply to the Consumer Disputes Board at the Estonian Consumer Protection Board for extrajudicial dispute resolution. The competence of the Consumer Disputes Board includes the resolution of disputes arising from the contract concluded between the Buyer and the Seller. The Consumer Dispute Committee's review of a complaint by the Buyer is free of charge. Disputes in Estonia shall be resolved at the Consumer Protection Board based on the laws of the Republic of Estonia. The Buyer may turn to the European Union Consumer Dispute Resolution Platform. 7.7 In case of disagreement with the decision of the Commission, the parties have the right to apply to the district court at the location of the Buyer. 8.
8. PROCESSING OF PERSONAL DATA
1.2. 8.1. Responsible processor of personal data is Magnetic Baltic OÜ (registration code 16633635), located at Väike-Põllu 7, Sindi linn, Pärnumaa, 86705, Estonia.
8.2 When processing personal data, the laws of Estonia and the European Union shall be observed.
8.3 The Controller shall collect the following personal data: name, telephone number, address, e-mail address, bank details. The data shall be used only for processing the order and sending the goods to the Buyer. The Seller transmits personal data to companies providing transportation services for the purpose of delivery of goods.
8.4 Personal data transmitted to the responsible processor is protected and treated as confidential information. The transfer of data between the customer and the banks is encrypted. The data processor does not have access to sensitive data of the bank and the customer's payment card. The data controller shall not disclose data that has become known to him to third parties.
8.5 The Data Controller may send newsletters, including satisfaction surveys and offers, to the Buyer's e-mail address only if the Buyer has given prior consent.
8.6 The Buyer shall have the right to file a complaint with the Data Protection Inspectorate or a court, if he or she finds that his or her rights have been violated in the processing of personal data.
